Common questions

Estate planning, answered

Do I really need an estate plan if I do not have much?

Yes. A plan is not only about money. It names guardians for your children, lets someone pay your bills if you are sick, and states your medical wishes. Almost every adult benefits from at least a basic plan.

What happens if I die without a plan in California?

State law decides who gets your property, and the court may have to oversee it through probate. That can take many months and cost your family thousands of dollars. A plan lets you decide instead of the state.

How often should I update my plan?

Review it every three to five years, or sooner after a marriage, divorce, birth, death, or a large change in what you own. Small updates are usually quick and inexpensive.

What is the difference between a will and a living trust?

A will still goes through probate court before your family receives anything. A living trust usually avoids probate entirely, which saves time, money, and privacy. Many plans use both, with the will as a backup.

How long does probate take in California?

Most California probates take about nine months to a year and a half, sometimes longer. The exact time depends on the estate and the court's schedule. We work to keep it moving.
